"The spectacle of a judge pouring over the picture of some nude,
trying to ascertain the extent to which she arouses prurient interests,
and then attempting to write an opinion which explains the difference
between that nude and some other nude has elements of low comedy."

"Low comedy", I like that. Of course, such judgments tell us more about the judge than they do about the nude.

I'm not sure how to rate this or comment on it with stars. There is a very base element of low comedy. For law or, justice application there is no way to address an individual benefit or what criminal harm will come from the use of the picture in the above stated scenario. Morality can not be legislated nor, can any judiciary lawfully legislate. The subject matter and standing is outside stated judicial purview.

We do have some nutty judges in this country. The scary part is these federal judges who are appointed for life.

clearly showing how crazy it is to worry about a few naked pictures... worry instead about the hungry child on the street who has to deal with violence as a daily part of their existence!

Elements of low comedy indeed! Get over it. If there was more nudity in life, there would be less perversion. We are encouraged to cover ourselves up, to keep putting on the act, to fear intimacy, to fear to even simply face reality as it stares us in the mirror! Puritanism is rooted in false doctrines and assumed authority over others.
