I'm not quite sure how to rate this. The entire argument is couched in legal positivism which is vulnerable to the criminal logic of the despots that would recognize no inalienable rights (man's right's are only those that the government says - it can give and take away rights by a mark of the pen.). The Bill of Rights was only to innumerate a extremely certain few rights that could not be legislated against, ruled in court against or enforced contrary to the individual sovereign's inalienable right.  -- Mike, Norwalk
