Law is generally divided ⋯ when considered as to their duration, laws are {laws of nature or natural law} immutable and arbitrary or positive; ⋯ An arbitrary law is one made by the legislator simply because he wills it, and is not founded in the nature of things; (Bouvier’s Law Dictionary) “Men who will govern, will construe laws and constitutions most favorably for increasing their own power.” (Richard Henry Lee – Declaration of Independence signer) Men that manage inalienable rights and liberty at natural law as servants for individual sovereigns will construe laws and constitutions most favorably for the increasing of their proprietor’s ability, authority and power. A fundamental legal premise in a “republican form of government” is nemo dat quod non haben = You can’t give what you don’t have: an individual sovereign can’t restrict the actions of a non-offending other (in person, property or commerce) nor, can he give such authority or ability to his servants. “Since when have we Americans been expected to bow submissively to authority and speak with awe and reverence to those who represent us?” (Justice William O. Douglas) A slight add on Where "natural law" ends, tyranny begins.
