"The power of the legislative being derived from the people
by a positive voluntary grant and institution, can be no other
than what that positive grant conveyed, which being only to make laws,
and not to make legislators, the legislative can have no power to transfer
their authority of making laws, and place it in other hands."

And yet, the lawyers become a power in themselves. They become a community of ruling elite, placing themselves above the common man. (Chat with one, suggest that it's possible, perhaps even desirable, for people to take the law into their own hands -- and see what he says & does. --for you will have spoken the unthinkable...for him.)

Courts are so corrupt today, this is no longer a recognized legalism. I've even used this concept in traffic cases where an obscure executive somebody made an arbitrary speed limit. hmm, I got an aaaawaa

Congress forgets themselves, and thus we forget, too. The American system of jurisprudence is supposed to protect us from power grabs from our government. Instead, Congress and the President assume they have the power to do whatever they pass a law to do. It doesn't work that way. There are well-drawn limits to what we have authorized Congress to do, and our 'representatives' have WAY exceeded their mandate.

Mike, Amen on your traffic cases a prime example are these gottsha traffic cameras municipalities have installed with an artificially low speed limit, the court has determined it violates due process under the Constitution and it clearly does so they get around that by making it a civil penalty run by an outside company that takes their cut off the top it's just a revenue-generating scam posing as safety.
I would also add the part about the transfer of power and authority the prime example for that is how Congress relegated money powers to the Federal Reserve .

The blindfold was removed, long ago, from Lady Justice ! Even the current, upstart lawyers, practice their crafty skill, tempered with ignorance ? It is very hard to argue, on behalf of Responsibility in wake of the current crisis !
