“As long as judges tinker with the Constitution to ‘do what the people want,’ instead of what the document actually commands, politicians who pick and confirm new federal judges will naturally want only those who agree with them politically.”

I think that "the People",in general, actually want the US Constitution to be interpreted as it was originally meant to be; as per the originators of the document and Not to be interpreted any other way.Only a truthful and contemporary application of Our US. Constitution is what is called for to guide our nation in the 21st century and for our "elected"leaders to abide by every letter of the document. As per this quote,I agree with the 2nd half of it.

What "2nd half of it". I didn't realize that the quote had 2 parts, sounds great to me, "both halves:.

What the hell that is how he got there so he should know. It is a fact of life that the constitution and all legal argument is a social science not a natural science. Natural science, engineering etcetera is subject to absolute measurements and meanings. Jefferson called for a revolution every generation. If the Constitution is so easy, simple and clear why do we need so many lawyers and Supreme Court Justices to interpret it.

As one of the recipients of appointment to be an activist judge, doing not even what the people want... or what the document actually commands, but rather to do what King George W & his handlers want... if he truly believed what he has said in this quote, he'd resign immediately... or, more appropriately, in January 2009!

Yep. But the jury really has the final say. Unfortunately today what people know about American Common Law is ZILCH. Thanks to public education, we have a nation of fools voting for their fair share of the Treasury (and actually think the government has any money of their own). Every branch of government attempts to overstep their Consitutional limits -- that is why each is to serve to check the power of the other.

This is the crux of the problem: a political judiciary. No man can completely divorce himself from his own political beliefs, but those that are honest with themselves and others will acknowledge it. They will also try to stick to a strict, disinterested interpretation of the law and not allow themselves to be bought with cash, flattery, or anything else. Why are there so many lawyers? Because so many judges can be bought.

So we mustn't tinker with the 2nd amendment but it's OK to tinker with the 4th...
