"Not surprisingly, the federal judiciary nearly always rules in favor of the federal government. Judicial review, contrary to the assurances of its advocates, has hardly restrained Congress at all. Instead it has progressively stripped the states of their traditional powers, while allowing federal power to grow unchecked."

Just another truth the 4th branch of government (governmental media complex) and the rest of the collectivist despots (government schools, politicos, etc.) keep from a dummied down class of helots, serfs, and slaves. Judicial review was never Constitutional but, promoted to advance unconstitutional tyranny.

It is so rare that the supreme court will rule by the constitution. Their issuing of Court Orders are also unconstitutional.

The routine argument is to defer to congress. Everytime they do the render themselves and our constitution useless. There is a mechanism to change the constitution by amendment. The judiciary is not it.

Based on court rulings over the last thirty years and especially under the Roberts court, the above quotation should be modified: "... The federal judiciary nearly always rules in favor of the federal government AND LARGE CORPORATE ENTITIES AGAINST THE CITIZENRY. Many on this blog view the world around us from the John Birch "The commies are coming, the commies are coming" position, but in reality it is the Corporate oligarchs that are seizing control of our government and implementing a corporate police state. We have failed to heed Eisenhower's admonishment and the result today is a federal court dominated by corporatist who have recently taken the final step toward realizing the corporate state. This movement, started with the fraudulent head-note associated with the Santa Clara County v Southern-Pacific Railroad (1886), has declared corporations "persons" with full rights under the Constitution as persons, and immortal persons at that.

Heathen Steven, you've commented here but just a short time, who do you think comments from a Birch perspective? Though the 10 planks of the communist manifesto have been fully implemented, it is the fascist administration that is the despotism / tyranny desired by the banker elite. You are absolutely right, fascism (corporatism) is the socialism of choice for destruction from within, with only a little communism thrown in here and there where needed and for a little added flavor. One needs only look at Bush / Obama Wall Street associations to prove the point.

Federal power is, indeed, growing unchecked and has been for many years.

The states gave some power to the Feds when they agreed to the Constitution, and they said that the federal power would be supreme in those limited instances.  Now, the Feds decide what powers they want and that their power is supreme in ALL instances they choose.  The states have no voice in the rulings.

Steven, your observation is spot on. Since the full and unconstitutional incorporation of government (local to federal; shortly after the War Between the States replaced the de jure States united)  corporate courts pick and choose which dogmas and entities best fit their time appropriate goals and aspirations.
